Arnald Car’s Terms and Conditions.
The terms and conditions and the web based form constitutes the entire agreement concerning the provision of an airport transfer service between you and Arnald cars.
Completion of the booking form and use of the services indicates your un conditional acceptance of the terms and conditions set out in this agreement.
1. Definition
Arnald Car’s means Arnald cars who is registered at Unit 7 Icknield way farm business park, Tring road, Dunstable ,Beds LU6 2JX. Vat number 150521942 Tel: 01582 868133 You and your means any individual, company or other business who places a booking with Arnald cars.
2. Booking
2.1 You must allow sufficient time when booking your vehicle to allow for the check in time required by your airline and any delays that could be caused by traffic conditions. Arnald Cars shall not be held responsible for any delay caused by your failure to leave yourself enough time to reach your destination or if the passengers are not ready for collection and the agreed time.
2.2 You must make sure you order a vehicle that is the correct size for your baggage and the amount of passengers you have. Arnald Cars cannot guarantee to carry excessive luggage. Please also note that a child no matter what age height and weight will count as one passenger and will take up a seat in the vehicle.
2.3 If you need to transport a wheelchair please advise on booking.
3. Price/Payment
3.1 Arnald Cars will email you a confirmation based on the information you have provided them with. Unless otherwise stated all prices will be included of the vat unless you are a business account customer then the invoice provided will have the vat shown. Arnald Cars may amend the confirmation if there is any material change to the original confirmation i.e.: number of passengers, luggage and size of vehicle.
3.2 The confirmation will include a 45 min waiting period after the advertised landing time in with original price also the parking fee at the airport. Arnald Cars if waiting time goes over the 45 mins stated they will charge the customer £5.00 for every half an hour of waiting time until the collection has been made. Arnald Cars will endeavor to check your flight landing time. Ultimately the responsibility falls with the customer to keep Arnald Cars informed of any major changes to time or cancelled flights.
3.3 If you accept your confirmation which will be emailed over to you this is what Arnald cars will use to place your booking. This needs to be thoroughly checked and any mistakes need to be changed as soon as possible. Arnald Cars will not be held responsible for any in correct information given and confirmation not being checked and changed if necessary.
3.4 Payment can be made to Arnald Cars by cash to the driver on collection, or by calling the office on the above number to pay over the phone with debit or credit card. Cheques will also be accepted as a form of payment.
4. The service
4.1 You shall be responsible for the behavior of all of your passengers in the vehicle during the journey. The cost of £80.00 will be charged to you if the vehicle is soiled whilst on the journey.
4.2 Eating, Drinking and smoking is not permitted in the vehicle at any point of the journey.
4.3 All children travelling during the journey need to be restrained according to their height, weight and age appropriately according to the law. Suitable chairs for the children can be supplied by Arnald Cars or your seat can be stored by us until your return.
4.4 Arnald Cars will not carry passengers if the vehicle becomes defective or their license doesn’t allow them.
4.5 Meet and greet at the airport can be arranged by us in the terminal at a cost to you the customer ask for this when booking your vehicle.
5. Cancellation
If you cancel your booking please contact Arnald Cars as soon as possible to avoid any charges. If the driver is on route for collection and you cancel you will be charge 10% of the original price. Arnald Cars requires at least 48 hours’ notice to cancel.
6. Liability
6.1 Arnald Cars shall use all reasonable endeavors to get you to your destination on time, but shall not be held responsible for any loss due to delays caused by roads works or traffic conditions beyond its control on your journey. Under no circumstance shall Arnald Cars be liable (in contract, tort or otherwise) for any loss of profit business or for any indirect or consequential loss whatever.
6.2 All luggage is carried entirely of the risk of yourself.
6.3 Arnald Cars shall be entitled to cancel all services and provide full refunds in the event of declaration of a national emergency, riot, war, fuel shortage, extreme weather conditions or terrorist attack or any other circumstance beyond its control. If the vehicle breaks down or becomes un fit to drive Arnald Cars will find a replacement vehicle to get you to your destination as per the agreed time.
6.4 You shall indemnity Arnald Cars against all losses, costs, damage and expenses arising from any act of or omission of any passenger in your party.
6.5 Neither party excludes or limits its liability for death or personal injury caused by the negligence or for willful default or fraudulent misrepresentation, or otherwise in any manner unenforceable by any applicable law.
7. Termination
7.1 Arnald Cars will refuse or terminate any booking with immediate effect if it places a risk to any of our drivers or any risk of violence or abuse by any passenger in your party. The passenger or passengers will also be asked to leave the vehicle.
8. Miscellaneous.
8.1 Arnald Cars may subcontract its obligation under this agreement but information supplied by you to us will be securly held. You shall not assign, transfer for or delegate any of your rights or obligation under this agreement.
8.2 Arnald cars may change the terms and conditions at any time by posting changes online. Please review terms and conditions before using our service to check all details remain correct.
8.3 Arnald Cars shall store, process and use all information regarding your personal details in accordance with the requirements of the data protection act 1998.
8.4 This agreement and any accompany confirmation represents the entire agreement between you and Arnald Cars in relation to the subject matter. If there is any discrepancy between terms and conditions and the confirmation the terms and agreements of Arnald Cars will prevail.
8.5 Nothing in this agreement is intended to conform any benefit on any third party whether pursuant to the contract (right of third parties) act 1999 or otherwise, and no third party shall have the right to enforce any rights under this agreement except where otherwise agreed in writing.
9. Disputes
This agreement shall be constructed in accordance with English law and you and Arnald Cars each agree to submit to the exclusive jurisdiction of the English courts in respect of any dispute or claim arising out of or in connection with this agreement.
10. Conveying children
Arnald Cars reserve the right to make sure all children are in the correct safety seat for the child’s age and height whilst in our vehicles.
